BEAR GRIP® Open Box Terms & Conditions
These terms apply to products sold by BEAR GRIP® as Open Box and supplement our general E‑Commerce Terms & Conditions and Returns Policy.
Nothing in these terms affects your statutory rights under UK consumer law.
1. What is an Open Box Item?
An Open Box Item is a product that is not sold as brand new. It may have:
- Been opened, returned, displayed or previously handled;
- Damaged, replaced, incomplete or missing original packaging;
- Minor marks, scratches, dents or other cosmetic imperfections; or
- Missing accessories or components where clearly stated in the product listing.
Open Box Items are normally sold at a reduced price to reflect their condition.
2. Inspection and Safety
Before an item is sold as Open Box, BEAR GRIP will inspect it to ensure that it:
- Functions as intended;
- Is reasonably safe and suitable for resale;
- Has no known major defect that makes it unsuitable for resale; and
- Matches the condition described in the listing.
Items that do not pass our inspection will not be sold as Open Box.
Certain returned products may not be suitable for resale for hygiene or safety reasons. These will only be resold where BEAR GRIP is reasonably satisfied that they are safe, hygienic and suitable for resale.
3. Product Condition and Description
Every Open Box product will be clearly identified as “Open Box.”
The product listing will clearly describe any known material issues, including where applicable:
- Cosmetic imperfections;
- Signs of previous handling;
- Damaged, replaced or missing packaging; and
- Missing accessories or components.
Customers should review the Open Box description before purchasing.
Any specific defect or condition clearly disclosed before purchase forms part of the product’s agreed description. A customer cannot normally claim that the product is defective solely because of that disclosed condition.
This does not affect the customer’s rights regarding any separate or undisclosed fault.
4. Your Consumer Rights
Open Box Items remain protected by the Consumer Rights Act 2015.
Goods must meet the applicable legal requirements, including being:
- Of satisfactory quality, taking account of matters such as their description, condition and price;
- Fit for purpose where the legal requirements apply; and
- As described.
If an Open Box Item is faulty, not as described or otherwise does not meet the applicable legal requirements, the customer may be entitled to the remedies provided by law, including where applicable:
- The 30-day short-term right to reject;
- Repair or replacement;
- Price reduction; or
- Final right to reject.
Selling an item as Open Box or at a discounted price does not remove these rights.
5. Online Returns and Cancellation
Where an Open Box Item is purchased online, applicable rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 continue to apply.
Unless a legal exception applies, customers generally have 14 days after receiving the goods to tell us they wish to cancel, even if the item is not faulty.
The customer must then return the item within the applicable legal return period.
For a change-of-mind return, the customer may be responsible for the direct return cost where this was communicated before purchase.
Where required by law, BEAR GRIP will refund the standard delivery charge. Any additional cost for a more expensive delivery option selected by the customer does not have to be refunded above the cost of our least expensive standard delivery option.
If the customer handles the item beyond what is reasonably necessary to establish its nature, characteristics and functioning and this reduces its value, BEAR GRIP may make an appropriate deduction from the refund where permitted by law.
6. Returns and Refunds
Open Box Items are subject to our general Returns Policy.
They must not be treated simply as “non-returnable,” “non-refundable” or “sold as-is” where doing so would restrict the customer’s statutory rights.
Nothing in these Open Box Terms limits the customer’s legal rights relating to faulty, misdescribed, unsatisfactory or otherwise non-conforming goods.
7. Internal Open Box Records
BEAR GRIP will keep an appropriate inspection record for Open Box Items, including where applicable:
- Product/SKU and inspection date;
- Functional and safety check;
- Cosmetic and packaging condition;
- Missing accessories or known defects;
- Approval or rejection for resale; and
- Inspector identification.
8. General Terms
These Open Box Terms form part of the contract between the customer and Train Wiser Ltd.
Our general E‑Commerce Terms & Conditions and Returns Policy also apply.
If these Open Box Terms conflict with a mandatory right under UK consumer law, the customer’s statutory rights will take priority.
